2. WHAT PERSONAL DATA DO WE PROCESS AND WHERE DOES IT COME FROM?

As part of your relationship with us, we may process different categories of personal data, always depending on the service or product contracted with us. This data may be collected through any of the means that Jeevan Ayurveda S.L. offers, both online and in person. The categories of data processed may be the following:
– Identifying data of natural persons: name and surname, ID/identification document, date of birth, place / city / country of birth, telephone, email, address, signature, electronic signature, social security number, voice, image, IP address, cookie ID, social media profile ID / links.
– Academic and professional data: education and qualifications, professional experience, membership in professional associations.
– Banking data: bank account number, credit card number

3. PURPOSE AND LEGITIMACY. WHY AND FOR WHAT PURPOSE ARE YOUR PERSONAL DATA USED?

Jeevan Ayurveda S.L. informs you that it may process personal data for the purposes indicated below, insofar as there is a legal basis for each processing.
The GDPR and the LOPDGDD establish that information about a person (their “personal data”) can only be processed if one of the legitimizing bases expressly provided for in these regulations applies. More specifically, and in this regard, Article 6 of the GDPR establishes a closed list of legitimizing bases that may apply to justify and legitimize personal data processing:
– Consent.
– Contractual relationship.
– Vital interests of the data subject or other persons.
– Compliance with a legal obligation for the controller.
– Public interest or exercise of public authority.
– Prevailing legitimate interest of the controller or third parties to whom the data is communicated.
Jeevan Ayurveda S.L. will carry out processing of your data, in some cases, under the legitimate interest provided for in Article 6.1.f) of the GDPR, as it considers that they do not harm the right of customers to the protection of their personal data. This provision authorizes carrying out those processing operations that are necessary for the satisfaction of legitimate interests pursued by the controller or by a third party, provided that the interests or fundamental rights and freedoms of the data subject requiring the protection of personal data do not override those interests, in particular when the data subject is a child.

Regarding such processing, you have the right to:
– Obtain more information about what that “legitimate interest” consists of.
– Know how Jeevan Ayurveda S.L. has reached the conclusion that they do not harm the protection of your personal data
– Or directly object to them. You can do so through the channels available to you in section 7 – RIGHTS YOU CAN EXERCISE -, indicating the specific processing to which you object and the reasons on which you base your request.

For all processing carried out based on legitimate interest, Jeevan Ayurveda S.L. has conducted what is known as a “balancing test”. This is an internal analysis to confirm that the legitimate interest of Jeevan Ayurveda S.L. does not harm the interests of its customers in the protection of their personal data. The main purposes for which your personal data may be used and the legitimizing bases for each processing are as follows:

Compliance with legal obligations

Purpose: compliance with accounting, legal, tax and administrative obligations.
Legitimacy: contractual execution, compliance with legal obligation.

Provision of online training services

Purpose: To manage your registration and participation in the online event/talk/workshop/course. The session will be recorded, so we will use your image according to the authorization you grant us.
Legitimacy: Contractual execution (registration for online training)

Provision of product marketing services

Purpose: To prepare personalized quotes for you, provide you with the requested services and invoice them.
Legitimacy: Pre-contractual and/or contractual execution

Management of your request to register as a website/platform user

Purpose: If you decide to register as a user on our website/platform, we need to process your data to identify you as a user and give you access to its different functionalities, products and services that are available to you as a registered user. You can cancel your registered user account by contacting us at info@jeevan-ayurveda.com
Legitimacy: Contractual execution. The processing of your data is necessary for the execution of the terms governing the use of the website/platform.

For the development, compliance and execution of the sale or service contract that you have
contracted with us through the website/platform

Purpose: This purpose includes the processing of your data to, mainly:
– Manage the payment for the products you purchase, regardless of the payment method used.
– Manage the shipment of the product or provision of services.
– Manage possible returns once you have made a purchase.
– Contact you regarding updates or informative communications related to the functionalities, products or services contracted, including sending quality surveys about the products or services provided.
Legitimacy: Contractual execution. The processing of your data is necessary for the execution of the sale or service contract that binds us with you. It is possible that some data processing associated with the purchase process is activated only because you request or authorize it, such as the storage of payment data (card) for future purchases. In these cases, the basis on which we process your data is your own consent.

Video surveillance

Purpose: Interior and exterior surveillance of the facilities in order to comply with the security operation and to prevent risks affecting the security and protection of people, premises and property as well as to report, when necessary, facts to the competent authorities or respond to their requirements.
Legitimacy: Public interest, given that its purpose is to guarantee the security of people, property and facilities.
When the legitimizing basis for processing is “Public Interest”, this processing must have a basis in Union or Member State law. In this regard, we cite the Ley 5/2014, de 4 de abril, de Seguridad Privada.

Use of image

Purpose: Capture, management, reproduction and/or publication of audiovisual files (photographs, videos…) in which natural persons appear on web pages, social networks, physical publications or any other medium.
Legitimacy: Your consent.

Contests, sweepstakes and events

Purpose: Management of your participation in contests, sweepstakes and other activities in which you have requested to participate.
Legitimacy: Your consent.

Sending quality surveys

Purpose: In order to evaluate the level of satisfaction of users with the products and/or services contracted, Jeevan Ayurveda S.L. will send quality surveys to obtain your opinion about them and thus be able to continuously improve the provision of its services.

Commercial communications (not expressly requested)

Purpose: In order to offer the user products and services that may be of interest, we will send you offers on products and services related to those already contracted or that you have contracted in the past with Jeevan Ayurveda S.L.. You may object to receiving these communications in each communication you receive.

Commercial communications

Purpose: Sending commercial communications about offers not related to the services and/or products contracted. You may object to receiving these communications in each communication you receive.
Legitimacy: Your consent.

Sending curriculum vitae

Purpose: To include it in personnel selection processes currently open or for future processes in which the candidate may fit, and may not be used for other purposes.
Legitimacy: Execution of pre-contractual measures.

By providing your data through any of the means provided, you guarantee the veracity of the data provided and commit to communicating any changes that may occur to them.
Remember that, when we ask you to fill in your personal data to give you access to some functionality or service, we will mark some fields as mandatory, since they are data that we need in order to
provide you with the service in question. Please note that if you decide not to provide us with that data, you may not be able to enjoy those services or functionalities or send us your request.

4. RETENTION OF YOUR DATA. HOW LONG WILL WE KEEP IT?

The personal data provided will be kept for as long as necessary to fulfill the purpose for which it is collected. Once this period has ended, we will keep your data duly stored and
protected during the required legal prescription periods. Once the possible actions in each case have prescribed, we will proceed to delete the personal data.

5. WHO DO WE COMMUNICATE YOUR DATA TO?

To fulfill the purposes indicated in this Privacy Policy, it is necessary that we give access to your personal data to entities that provide us with support in the services we offer you, namely:

  • Financial institutions
  • Technology service providers
  • Business advisory entities
  • Social Security
  • Tax Agency

Apart from those mentioned, Jeevan Ayurveda S.L. will not transfer personal data to third parties, except by legal obligation. However, in the event that they are transferred to any third party, the user will be previously informed
requesting express consent for such transfer. The entity responsible for the database, as well as those who intervene in any phase of processing and/or the entities to whom they have been communicated – in any case always with the corresponding authorization granted by the user -, are obliged to observe professional secrecy and to adopt the levels of protection and technical and organizational measures necessary within their reach to guarantee the security of personal data, avoiding, as far as possible, unauthorized access, illicit modifications, theft and/or loss of data, in order to ensure the corresponding level of security of the files, according to the nature and sensitivity of the data provided by the users of this website.

6. RIGHTS YOU CAN EXERCISE

You can exercise any of the rights that we explain below, simply by indicating the reason for your request and the right you want to exercise. If we deem it necessary to identify you, we may request a copy of a document proving your identity.
In general, you will always have the right to:

  • Request access to your personal data, to know what data we have about you.
  • Request the rectification of your data: please note that, by actively providing us with your personal data by any means, you guarantee that it is true and accurate and commit to notifying us of any change or modification thereof.
  • Request that we delete your data to the extent that it is no longer necessary for the purpose for which we need to process it as we have informed you above, or in which we no longer have legitimacy to do so.
  • Request that we limit the processing of your data, which means that in certain cases you can ask us to temporarily suspend the processing of data or keep it beyond the time necessary when you may need it.
  • Request the portability of your personal data. This means that you will have the right to receive the personal data you have provided us in a structured, commonly used and machine-readable format, in order to transmit it to another entity directly, whenever technically possible.
  • Request the right to object to the processing of your data when the processing of your data is based on our legitimate interest.

Jeevan Ayurveda S.L. must respond to the request within one month from receipt of the request.
This period may be extended by another two months if necessary, taking into account the complexity and number of requests.
You have the right to withdraw consent given at any time by sending an email to info@jeevan-ayurveda.com. The withdrawal of consent will not affect the lawfulness of the processing carried out before the withdrawal of consent.
If you consider that your right to the protection of your personal data has been violated, you may file a complaint with the Spanish Data Protection Agency, www.aepd.es.

7. WHAT HAPPENS IF YOU PROVIDE US WITH THIRD PARTY DATA OR IF A THIRD PARTY HAS PROVIDED US WITH YOUR DATA?

There are occasions when you may provide third party data, for example, contact persons. If you provide us with Personal Data of third parties, you guarantee that you have informed them about the purposes and the
way in which we need to process their personal data.
If a third party has provided us with your data, we will process it within the purposes set out in this Privacy Policy.

Jeevan Ayurveda S.L. guarantees the adoption of appropriate measures to ensure the confidential processing of your data given their reserved nature and undertakes that said data remains secret, treating it with the utmost discretion, and declares to have implemented in its information system the security policies corresponding to the type of data handled in accordance with the provisions of REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR).
All data provided through our platform is collected through a secure protocol.

Our website:
– Has an SSL certificate that allows that when a user visits our website and exchanges information with us, an encrypted connection is established.

9. CHANGES TO THE PRIVACY POLICY

We may modify the information contained in this Privacy Policy when we deem it appropriate, in compliance with, for example, legislative or jurisprudential changes. If we
do so, we will notify you in different ways through changes on the website, or we will even communicate it to your email address when the change in question is significant for your privacy, so that you can review the changes, evaluate them and, if appropriate, object or unsubscribe from a service or functionality.
